The 3 Fights That Could Wreck Immigration Reform | TPMDC

It seems everything?s coming up Milhouse for immigration reform this week. The Senate and White House are pushing fairly similar plans, conservative leaders like Sen. Marco Rubio (R-FL) are working overtime to charm the right, and even some hardline amnesty foes like Rep. Steve King (R-IA) sound like they?re coming around. What could possibly go wrong?

Well, at least three things, according to Sen. Chuck Schumer (D-NY), who identified these ?very tough issues? as the biggest obstacles to a deal.

?First, defining metrics that demonstrate the border is secure,? he told reporters on Thursday. ?Second, defining exactly what the path to citizenship looks like and how it proceeds. [Third,] reaching an agreement between business and labor on a future flow program.?

Democrats are still optimistic about passing a bill, but if things do go sour, it?s almost certain one of these three issues is the culprit. Here?s why.

Border Security

Tougher border security has always been the carrot immigration reformers dangle to try to get conservatives on board with a comprehensive bill and this year?s push is no exception. The standout feature of the Senate?s bipartisan plan is a series of border enforcement measures that have to be met in order to ?trigger? the part of the bill that the right hates the most, namely a path to citizenship for undocumented immigrants.

The White House isn?t opposed to tightening the border as part of a deal per se, but President Obama and reform advocates are concerned that making it a precondition to applying for a green card could become an excuse to delay citizenship indefinitely for millions of newly legal immigrants. Sen. Marco Rubio (R-FL), the leading conservative voice in the bipartisan group, has warned he will walk away from the table if he thinks the final bill doesn?t keep the security threshold high enough.

The Senate?s plan also calls for a commission of Southwestern governors and other state officials to oversee the process. Members of the Senate group backing the idea say the ultimate decision on the trigger would be left to the Department of Homeland Security and that it?s unconstitutional to give the commission a veto, but conservatives could still press to expand their role in a final deal or give Congress a greater say in determining whether the border is secure. And then there?s the metrics used to define a secure border. Democrats want an easily measurable checklist, like number of agents deployed or whether or not they have enough drones in the air. But the vaguer the definition, the better chance immigration reform opponents have of slowing down the naturalization process in the future.

Pathway To Citizenship

Both the Senate and White House agree that any bill must allow undocumented immigrants to someday become citizens. But depending on how the legislation is crafted, that ?someday? could mean ?the near future? or ?the future with flying cars.?

That?s because the current legal system is ill-equipped to process 11 million undocumented immigrants anytime soon. Many of them work in low-skill jobs, a category that offers up only 5,000 green cards a year, and the backlog for various other family and employment categories are already decades long as well.

The White House wants to overhaul the visa process to guarantee a ?reasonable? timeframe for approval that doesn?t take decades. But Rubio has expressed skepticism of tinkering with the existing system and Democratic members of the working group told TPM they had yet to figure out a plan for how to address the green card backlogs.

One of the right?s biggest fears about a path to citizenship is that newly naturalized Hispanic immigrants will vote Democrat, so if they can?t stop a bill from passing at all, their next move is to try and make the process take as long as possible. Based on the early response from various conservative media figures to the Senate plan this week, that fight is going to get ugly fast.

Future Immigration

Critics of immigration reform complain that Congress granted illegal immigrants citizenship in 1986 only to end up having the same debate today. Reformers agree, but they disagree on how to prevent it from happening again.

Business groups argue that the solution is a guest worker program that lets them bring in vastly more legal immigrants to work low-skill jobs like agriculture or meatpacking that they claim Americans don?t want to do. But labor unions are worried that employers will use imported labor to drive wages down and undercut organizing workers. They want stricter controls on how many legal immigrants are allowed in, ideally through a commission that determines which sectors of the economy actually have shortages.

This debate isn?t just a theoretical problem. Schumer cited it on Thursday as the leading factor in killing President Bush?s 2007 reform effort. That Senate bill included a guest worker program but it was later amended to slash the amount of workers allowed into the country. The result pleased no one ? pro-labor Democrats still voted against it and business groups were less motivated to pressure border hawk Republicans into voting yes.

This year, the major unions and the Chamber of Commerce are trying to negotiate a solution to avoid scuttling a second bill. But they?ve yet to reach an agreement and if either group decides to back out, the whole thing becomes much harder to get past Congress.

RI moves toward gay marriage, faces one more big vote

PROVIDENCE, R.I. (AP) ? Legislation that would make Rhode Island the 10th state to allow gays and lesbians to marry still faces an uncertain future despite being overwhelmingly approved by the state House on Thursday night.

It could be weeks or even months before the Senate takes up the bill that would make the Ocean State the last in New England to recognize same-sex marriage, but supporters still celebrated the House vote.

Ken Fish, a gay man from Warwick, showed up at the Statehouse hours before the vote to ensure he got a seat in the crowded viewing gallery.

"I wanted to be here to see it," said Fish, 70, "Go back 10 years, even five years, and I wasn't sure we'd ever get here. We're not done yet, but this is a big one."

While the House has a gay marriage champion in Speaker Gordon Fox, who is gay, Senate President Teresa Paiva Weed opposes the legislation.

The 51-19 House vote came after an often emotional debate that touched on civil rights, religion and the nature of marriage.

"This has been a long journey," Fox said after the vote. Fox supported same-sex legislation when it was first introduced in 1997. "Today is a great day. Today ... we stand for equality, we stand for justice."

Nine states and the District of Columbia now allow gay and lesbian couples to marry.

Gov. Lincoln Chafee, who supports gay marriage, urged quick action on the bill in the Senate. The governor, an independent, argues gay marriage is an issue of civil rights and the state's quality of life, and said some people may choose other New England states over the Ocean State because of its stance on marriage.

"Now that the House has swiftly acted, I urge Senate leadership to 'call the roll' ? for our economy, for our gay and lesbian friends and neighbors, and for history," he said in a statement.

Advocacy groups on both sides of the issue will now turn their attention to the 38-member Senate, which has never voted on gay marriage legislation.

Chris Plante, director of the state chapter of the National Institute for Marriage, said he's optimistic senators will vote to preserve the state's current marriage laws. He said leaders like Fox and Chafee don't reflect public sentiment.

"Rhode Islanders care about marriage, and they don't want to see it redefined," he said.

Some opponents have suggested placing gay marriage on the ballot as a referendum, but the idea is a nonstarter with Fox and Chafee.

A handful of lawmakers rose during Thursday's debate to criticize gay marriage as a dangerous social experiment. Rep. Arthur Corvese, D-North Providence, warned lawmakers that same-sex marriage was an "irrevocable societal game-changer" that would redefine "the fundamental building block of our community" and could lead to the legalization of polygamy or plural marriages.

"Truth must not be sacrificed on the altar of political correctness," he said. "Is this the vision you want for Rhode Island's future? Is this the future you want for America?"

Supporters in Rhode Island are hoping to build on national momentum after votes to approve gay marriage in Maine, Maryland and Washington. Meanwhile, in Minnesota, voters rejected a proposed state constitutional amendment that would have prohibited gay marriage, the first time such a ballot question has failed in the United States.

Lawmakers who argued in favor of allowing gays to marry warned their colleagues they could wind up on the wrong side of history if they cast a no vote.

"Your grandchildren someday will ask you... 'How did you vote on marriage equality?'" said Rep. John Edwards, D-Tiverton. "Hopefully you'll be able to say the right thing."

Two years ago, Fox dropped gay marriage legislation after he concluded the bill would not pass the Senate. Instead, lawmakers passed civil unions for same-sex couples. But there has been little interest in the state. In the year since civil unions were first offered, only 68 couples obtained civil union licenses.

Last year, Chafee signed an executive order recognizing same-sex marriages performed in other states.

Surprisingly, Windows Phone?s market share also ticked down to 2.6% in December from 2.7% in November. That might be a statistical artifact, but it is surprising not to see a substantial boost in Windows share considering the marketing support and new devices from AT&T (T). In Europe, Windows Phone is rapidly picking up steam. Its market share soared to 13.9% in Italy from 11.8% in November. In the UK, Windows Phone?s share moved to 5.9% from 5.1% in a month. The EU average share of Windows Phone bloomedhttp://news.yahoo.com/apple-slips-blackberry-slides-windows-phone-stalls-december-134508775.htmlTue, 22 Jan 2013 08:45:08 -0500BGR Newsapple-slips-blackberry-slides-windows-phone-stalls-december-134508775Verizon Q4 loss doubles to nearly $2 billion despite record subscriber addsA record 2.1 million net postpaid subscriber additions and record fourth-quarter smartphone activations couldn?t offset huge charges related to pensions and costs associated with Hurricane Sandy, leaving Verizon (VZ) with a $1.93 billion loss in the holiday quarter. Frontiers publishes systematic review on the effects of ... - Health.am

Yoga has positive effects on mild depression and sleep complaints, even in the absence of drug treatments, and improves symptoms associated with schizophrenia and ADHD in patients on medication, according to a systematic review of the exercise on major clinical psychiatric disorders.

Published in the open-access journal, Frontiers in Psychiatry, on January 25th, 2013, the review of more than one hundred studies focusing on 16 high-quality controlled studies looked at the effects of yoga on depression, schizophrenia, ADHD, sleep complaints, eating disorders and cognition problems.

Yoga in popular culture
Yoga is a popular exercise and is practiced by 15.8 million adults in the United States alone, according to a survey by the Harris Interactive Service Bureau, and its holistic goal of promoting psychical and mental health is widely held in popular belief.

?However, yoga has become such a cultural phenomenon that it has become difficult for physicians and patients to differentiate legitimate claims from hype,? wrote the authors in their study. ?Our goal was to examine whether the evidence matched the promise.?

Benefits of the exercise were found for all mental health illnesses included in the review, except for eating disorders and cognition problems as the evidence for these was conflicting or lacking.

Dr. P. Murali Doraiswamy, a professor of psychiatry and medicine at Duke University Medical Center, US, and author of the study, explained that the emerging scientific evidence in support of the 5,000 year old Indian practice on psychiatric disorders is ?highly promising? and showed that yoga may not only help to improve symptoms, but also may have an ancillary role in the prevention of stress-related mental illnesses.

According to Stephen Cope, a psychotherapist and author of Yoga and the Quest for the True Self, hatha yoga?s postures improve mood by moving energy through places in the body where feelings of grief or anger are stored. ?Hatha yoga is an accessible form of learning self-soothing,? he says. ?These blocked feelings can be released very quickly, [creating a] regular, systemic experience of well-being.? Yoga students may also benefit from their relationship with the yoga instructor, Cope said, which can provide a ?container? or a safe place for investigating, expressing and resolving emotional issues. The instructor?s encouraging and accepting words may also help students defeat self-limiting notions.

Not all mental health practitioners are convinced of yoga?s healing powers, but many agree it can be helpful when combined with more traditional treatments. Zindel Segal, Ph.D., a University of Toronto psychiatry professor, recently studied SRRP when used in conjunction with cognitive therapy. He asked 145 people who were at risk for depression to undergo cognitive therapy either alone or with the SRRP. Segal found that after eight weeks of treatment, those participants who received both types of therapy were much less likely to relapse into depression. ?This means that people can learn about their emotions not just by writing down their thoughts, which is what cognitive therapy is all about, but also by paying attention to the way their emotions are expressed in their bodies,? he says. ?Both approaches allow people to observe their experience without judgment, an important first step in stepping out of depression.?

While yoga?s therapeutic capabilities are still under scientific scrutiny, Smith isn?t waiting for more proof. Having lost her grandmother to depression- she was one of many bipolar sufferers who take their own life due to the disease- Smith is determined not to let the disorder get the best of her. Since 1994, she has practiced and taught hatha yoga to depression sufferers- passing on what she believes has literally saved her life.

The review found evidence from biomarker studies showing that yoga influences key elements of the human body thought to play a role in mental health in similar ways to that of antidepressants and psychotherapy. One study found that the exercise affects neurotransmitters, inflammation, oxidative stress, lipids, growth factors and second messengers.

Yoga is no longer a traditional fitness workout. The National Institute of Mental Health and Neuro-Sciences (Nimhans) not only has a 45-minute yoga package to treat psychiatric disorders like depression and schizophrenia, but has started comparing its curative effects with general medicine.

Doctors at Nimhans say their studies reveal evidence of biological changes in the body brought about by yoga. They prescribe yoga therapy along with medication in major ailments, while using yoga therapy alone for less serious disorders.

Unmet need among mental health patients

Depression alone affects more than 350 million people globally and is the leading cause of disability worldwide, according to the World Health Organization (WHO). On World Mental Health Day last year, the WHO called for improved access to treatments.

While there has been an increase in the number of medications available for mental health disorders, many of which can be life saving for patients, there remains ?a considerable unmet need,? according to Dr. Meera Balasubramaniam, lead author of the study, who is also based at Duke University, US.

When you hear the word ?depression?, probably the first thing that will come to your mind is sadness. And yes, you thought right. Depression is a state of sadness. However, it is not to be confused with major depression, which is a mental condition characterized by a severe state of sadness or melancholy that has reached the point of hindering a person from functioning well socially.

While simple depression (or a depressed mood) may only last for a short time and can be treated easily, major depression can last for a longer time and treatment can vary from person to person. Major depression is also more dangerous because not only does it disrupt your social functions, but it has more serious symptoms such as:

Being fatigued physically and mentally

Change in appetite

Feeling of intense fear or melancholy

Irritability

Loss of interest in usual activities

Changes in sleeping patterns (e.g. insomnia, excessive sleep, or loss of REM sleep)

Trouble in decision-making or in concentrating

Feelings of guilt, hopelessness, or helplessness

Delusions or hallucinations

Recurring thoughts of suicide or death

Poor compliance and relapse as well as treatment resistance are growing problems, and medications are expensive and can leave patients with significant side effects.

US military cargo planes to help French in Mali

Joe Penney / Reuters

French military pass the the town of Konobougou on their way to Segou, Mali, on Jan. 17. European Union states will send more than 200 military personnel to train Mali government forces in the fight against Islamist rebels.

By Jim Miklaszewski and Courtney Kube, NBC News

U.S. military support for French military operations in Mali will soon include an airlift -- U.S. military planes will fly French personnel and equipment to the area.

A U.S. defense official told NBC News that the military is in the planning stages of an effort to transport the equivalent of about 30 C-17-sized planeloads of French troops and gear from France to Mali.

Most of the U.S. military planes will fly from the continental U.S. over to France for the mission, but least two Marine Corps KC-130 transport planes from a Navy base in Sigonella, Italy, are also likely to be called in to help. The U.S.-based planes are likely to be a mix of C-17s and C-5s, the U.S. defense official said.

The U.S. cargo planes may not land inside Mali, one U.S. official said, explaining that the U.S. is not interested in putting boots on the ground as the French fight Islamist militants in their former colony. The cargo planes would need support on the ground to unload, so the military is working out options, including landing the planes in Niger or Senegal.

The U.S. military is also awaiting orders to help the French military with re-fueling French planes.

Several U.S. military and defense officials have also told NBC News that a Marine Corps Fleet Anti-Terrorism Security Team remains ready to deploy to Mali to help with embassy security if necessary.

After tripling its number of troops to help stop Islamist fighters advancing on Mali's capital, the French president has pledged to stay in Mali until stability has returned. Meanwhile, A UK transport has arrived and thousands of African troops are on the way. ITV's Rohit Kachroo reports from Mali's capital
